Mitigating an Emergency with Care
Emergency vehicles must navigate numerous changing factors in their dedication to reaching a scene. When accidents arise, Rissman steps in to ensure our clients experience a premium defense tailored to their circumstances.
In a recent three-day jury trial, Rissman attorneys Juan Ruiz and Aaron Eagan obtained a defense verdict. Our client, an emergency vehicle, was making a wide right turn while responding to an accident when the plaintiff attempted to pass and overtake the ambulance on the right. The plaintiff’s vehicle sustained disabling damage, captured on video by the ambulance dashboard camera.
Both the plaintiff and our client presented testimony relating to the plaintiff’s sustained injury and subsequent care costs. Ultimately, the defense opined that the dashcam video demonstrated our client had done everything correctly to operate the vehicle within the necessary safety requirements.
The jury deliberated for just over ten minutes before returning a defense verdict finding no negligence on the part of our client.
After the Court granted a directed verdict in our client’s favor on the issue of future medical bills, the jury returned a complete defense verdict.
