The Intricacies of Medical Testing

In a recent medical malpractice trial that lasted nine days, Rissman attorneys Skip Jewett and Art Young obtained a complete defense verdict in favor of a doctor and nurse.

The plaintiff alleged that during his admission, a critical test was not performed, thus leading to another admission. However, the parties’ expert witnesses disagreed on whether this test would have been appropriate upon first admission because it was invasive and the plaintiff did not exhibit symptoms requiring the test.

After a five-hour deliberation, the jury returned a verdict for Rissman’s clients.
